1. Acceptance of Terms
By accessing or using Crew Forge (\"the Service\"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users of the Service, including business owners, administrators, and technicians.
2. Description of Service
Crew Forge provides field service management software that enables businesses to manage jobs, dispatch technicians, track work orders, and invoice customers. The Service is provided \"as is\" and may be updated, modified, or discontinued at any time without prior notice.
3. Account Registration and Security
To use the Service, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your team members comply with these terms
4. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to other accounts or systems
- Interfere with or disrupt the Service or its servers
- Upload malicious code, viruses, or harmful data
- Resell or redistribute the Service without authorization
- Use the Service to send spam or unsolicited communications
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you input into the Service. We will not sell your data to third parties. We may use aggregated, anonymized data for improving our Service.
By using the Service, you acknowledge and agree that we may analyze your account data — including job history, revenue, technician performance, and customer information — to generate periodic business insights, performance reports, and recommendations. These reports are derived solely from your own data and are delivered only to your account email. This analysis is performed as part of the Service to help you make better business decisions.
6. Payment and Billing
Crew Forge operates on a simple, transparent pricing model:
- One-Time Onboarding Fee (tiered): A single payment based on the plan you choose — Basic ($499), Pro ($899), Elite ($1,299), or Enterprise (contact us). This fee grants permanent access to Crew Forge with unlimited technicians at your selected tier. Onboarding fees are non-refundable except as required by law. You may upgrade tiers at any time by paying the difference.
- Per-Invoice Service Fee (tier-based): A small per-invoice fee is automatically added to each invoice when submitting jobs to QuickBooks or collecting COD (Collect on Delivery) payments. The fee varies by plan: Basic — $0.79/invoice, Pro — $0.69/invoice, Elite — $0.49/invoice, Enterprise — $0.49/invoice. Fees accrue as jobs are completed and are billed monthly in a single charge to your credit card on file. This fee covers ongoing platform maintenance, QuickBooks integration, and support services. You may discount or waive this fee for your customers at any time by applying a line-item discount on the invoice — however, your account will still be billed the per-invoice fee regardless of any customer-facing discount.
Customer Fee Policies & Monthly Caps
You may configure a per-customer fee policy in your account settings. Customers set to "Capped" will have the per-invoice fee waived (both on invoice and billing) after reaching the monthly cap (default 5 invoices per calendar month, configurable). Customers set to "Exempt" will not see the fee on their invoice, but your account will still be charged the per-invoice fee for your tier.We reserve the right to modify the default monthly cap threshold with 30 days advance notice.
We reserve the right to modify these fees — including per-invoice rates and onboarding pricing — with 30 days advance notice. Per-invoice fees accrue as jobs are completed (whether submitted to QuickBooks or collected as COD) and are billed monthly in a single charge to your credit card on file. Failure to maintain valid payment information may result in suspension of service features.
7. Customer Obligations – Fee Disclosure
IMPORTANT: You agree, as a material condition of your use of Crew Forge, to disclose the Crew Forge Field Service Management Fee per completed job to every customer in all estimates, work orders, and final invoices.
You must use the exact line-item language provided by Hynds AI:
"Field Service Management Fee – Covers real-time AI dispatching, tracking, invoicing, and compliance via Crew Forge."
This fee recovers platform costs and was disclosed to you at sign-up. Crew Forge will automatically include this line item in all invoices submitted to QuickBooks. You may adjust this setting in your account preferences, but you remain responsible for ensuring customer disclosure regardless of the automatic insertion setting.
Failure to comply with this disclosure requirement is a material breach of these Terms and may result in immediate suspension or termination of your account.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADE FLOW SYNC, HYNDS AI LLC, AND THEIR RESPECTIVE AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
9. Indemnification
You agree to indemnify, defend, and hold harmless Crew Forge, Hynds AI LLC, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your access to or use of the Service.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may export your data before termination.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of significant changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.
